1. General Provisions
1.1. These Purchase and Sale Rules (hereinafter referred to as the Rules) are a legally binding document that identifies the mutual rights, obligations and responsibilities of the person acquiring the goods (hereinafter referred to as the Buyer) using the MB UTA studio (hereinafter referred to as the Seller) online store https://uta-studio.com (hereinafter referred to as the Online Store) and the Seller when purchasing goods in the Online Store.
2. Rights and Obligations of the Buyer
2.1. The Buyer shall have the right to purchase goods in the Online Store in accordance with the procedure established by these Rules and other information sections of this Online Store.
2.2. The Buyer undertakes to accept the ordered goods and pay the pre-agreed price for them.
2.3. In case of discrepancies due to the received goods or other questions, the Buyer undertakes to immediately inform the Seller thereof by e-mail: oders@uta-studio.com.
2.4. If the data provided in the Buyer’s profile changes, the Buyer must update them immediately.
2.5. The Buyer undertakes not to pass on his/her login details to third parties. If the Buyer loses the login data, he/she must immediately inform the Seller thereof by e-mail: orders@uta-studio.com.
2.6. When purchasing the goods, the Buyer understands that the shade of the goods/packaging may differ from the shade shown in the picture.
2.7. By confirming the order, the Buyer hereby confirms that all the information provided in the order is accurate.
2.8. By ordering goods through the Online Store, the Buyer hereby agrees to these Rules and undertakes to comply with them.
3. Rights and Obligations of the Seller
3.1. The Seller undertakes to create all conditions for the Buyer to properly use the services provided by the Online Store.
3.2. If the Buyer tries to compromise the stability and security of the Online Store or violates his/her obligations, the Seller shall have the right to immediately and without notice restrict or suspend the Buyer’s access to the Online Store or, in exceptional cases, cancel the Buyer’s profile.
3.3. The Seller undertakes to respect the Buyer’s right to privacy of the personal information belonging to the Buyer specified in the Online Store profile registration form and to process it in accordance with the legal acts regulating the protection of personal data.
3.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer and in accordance with the Goods Delivery Rules (hyperlink to the Goods Delivery Rules).
4. Liability of the Buyer and Seller
4.1. The Buyer shall be fully liable for the accuracy of the personal data provided by the Buyer. If the Buyer does not provide accurate personal data in the Buyer’s profile registration form, the Seller shall not be liable for the consequences and shall acquire the right to claim compensation for direct losses incurred from the Buyer.
4.2. The Buyer shall be liable for the actions taken while using this Online Store.
4.3. Upon registering, the Buyer shall be liable for transferring his/her login data to third parties. If the services provided by the Online Store are used by a third party who has logged in to the Online Store using the login details of the Buyer, the Seller shall consider this person to be the Buyer.
4.4. If the Online Store contains links to the websites of other companies, institutions, organisations or persons, the Seller shall not be liable for the information or activities performed there, as it does not maintain, control and represent those companies and persons.
4.5. In the event of damage, the Seller and the Buyer shall indemnify each other only for the direct losses caused by their wrongdoing (e.g. the Seller shall indemnify the Buyer for the direct damages caused by the Seller’s wrongdoing).
